The terms governing your organisation's subscription to and use of the Pulspective platform.

These Terms of Service (“Terms”) constitute a legally binding agreement between the healthcare organisation or entity subscribing to the Service (“Customer”, “you”, or “your”) and Pulspective (“Pulspective”, “we”, “our”, or “us”).
By accessing or using the Pulspective platform, you confirm that you have authority to bind the Customer to these Terms and that the Customer agrees to be bound by them.
Pulspective provides a software-as-a-service platform that enables healthcare organisations to collect anonymous wellbeing check-in data from nursing staff, analyse aggregated ward-level trends, and communicate with nursing teams — all in a privacy-preserving manner.
The Service is a business-to-business offering. Individual nurses use the platform anonymously and do not enter into a contractual relationship with Pulspective. The Customer is responsible for ensuring nurses are informed about the platform and its purpose.
Manager accounts are provisioned by Pulspective upon onboarding. You are responsible for:
We are not liable for any loss arising from unauthorised use of your account where you have failed to take reasonable precautions to protect access credentials.
You agree that you will not:
Pulspective reserves the right to suspend or terminate access immediately and without notice if we reasonably believe you are in breach of the acceptable use provisions, in particular any attempt to de-anonymise nurse data.
Subscription fees are as set out in your order confirmation or commercial agreement with Pulspective. Fees are billed in advance for each billing period (monthly or annual). Unless otherwise agreed:
Your data is yours. All check-in response data, concern submissions, and ward analytics collected through the Service remain the property of the Customer. Pulspective processes this data solely on your instruction and in accordance with our Data Processing Agreement.
Pulspective retains aggregated, anonymised, and non-identifiable statistical data derived from use of the Service for the purpose of improving the platform. No individual-level or Customer-identifiable data is used for this purpose.
Your use of the Service is also governed by our Privacy Policy.
Pulspective and its licensors own all intellectual property rights in the Service, including the platform, software, algorithms, design, and documentation. Nothing in these Terms transfers any IP rights to you.
You grant Pulspective a limited, non-exclusive licence to host, process, and display your data solely to the extent necessary to provide the Service.
We will use commercially reasonable efforts to maintain the availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to scheduled maintenance (for which we will provide advance notice where practicable) or circumstances beyond our reasonable control.
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Pulspective disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Service is a wellbeing monitoring tool and does not constitute medical advice, clinical assessment, or a substitute for occupational health services. Decisions about employee health, staffing, or clinical care remain the Customer's sole responsibility.
To the maximum extent permitted by applicable law, Pulspective's total aggregate liability to the Customer for any claims arising under or in connection with these Terms — whether in contract, tort (including negligence), or otherwise — shall not exceed the total fees paid by the Customer to Pulspective in the 12 months preceding the event giving rise to the claim.
In no event shall Pulspective be liable for any indirect, consequential, incidental, special, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities, even if advised of the possibility of such damages.
Either party may terminate the subscription by providing 30 days' written notice. Pulspective may terminate immediately if:
Upon termination, the Customer's access to the Service will cease. Pulspective will make Customer data available for export for 30 days following termination, after which it will be permanently deleted.
These Terms are governed by and construed in accordance with the laws of Singapore. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.
We may update these Terms from time to time. Where changes are material, we will notify you by email at least 30 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.
